Mental Privacy and Algorithmic Inference
How neural, biometric, behavioral, conversational, and contextual data can be used to infer mental states—and why inference is not proof.
Scope
Mental privacy concerns direct neural data and indirect inferences about emotion, attention, intention, vulnerability, belief, or cognitive state from biological and behavioral traces.
Public significance
Institutions can cause severe harm without literally reading thoughts. A probabilistic guess becomes consequential when it influences employment, education, insurance, policing, border decisions, benefits, or targeted persuasion.

Neural and biological data can receive heightened legal protection, and major psychological research disputes simple universal mappings from facial movement to internal emotion.
Evidence boundary
Accuracy and harm vary by signal, context, population, deployment, base rate, and institutional consequence. No single rule establishes validity for every system.
